His attorneys called Park’s California filing a form of “gamesmanship,” arguing that it disregarded the child’s established home and routines. In a statement filed in May, Post said Park had “intentionally” misled the court by omitting their daughter’s Utah residency status. He emphasized his willingness to co-parent but firmly opposed the idea of uprooting the child’s life.
“I do intend to work cooperatively with Jamie to ensure that DDP has frequent and equal custodial time with her mother,” he wrote. “However, I do not consent to Jamie’s back door attempt to change DDP’s residence from Utah to California.”
On Monday, Park dropped the California case with prejudice—a key detail that means she can’t refile the same claim in the future. That decision effectively hands Post a legal win and cements Utah as the state where their ongoing custody case will continue. While the proceedings in Utah remain sealed, this development sets a definitive tone for what’s ahead.
Reps for both parties declined to comment, but the legal move suggests that Malone’s push to keep his daughter in a familiar environment—close to his own home and away from the media circus of Los Angeles—has prevailed for now.
